Bluecrest Terms of Service

Welcome to Bluecrest (“Bluecrest,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Bluecrest web and mobile applications, websites, and related services (collectively, the “Services”). By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree, do not use the Services.

1) Who We Serve

Bluecrest is designed for pool service companies (“Company Users”) to manage operations such as route assignments, service logs, communications, invoicing, and payments. Company Users may invite their staff (e.g., technicians) and interact with their own customers (“End Customers”) through the Services.

2) Accounts, Roles, and Security

  • You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account.
  • Roles may include (for example) admin, admin1, tech, and customer. Certain features are accessible only to specific roles.
  • You must promptly notify us of any suspected unauthorized access: support@bluecrest.app.

3) Subscriptions, Billing, and Stripe Connect

  • Company Users may purchase paid plans. Fees, billing intervals, and plan limits are shown at sign‑up and may change with notice. All fees are non‑refundable except where required by law.
  • Payments from your End Customers are processed via Stripe and/or Stripe Connect. You authorize Bluecrest to create and manage connected accounts and to pass through applicable Stripe fees. Your use of Stripe is subject to Stripe’s terms and policies.
  • You are responsible for taxes (e.g., sales/use, VAT) related to your subscription and to payments collected from your End Customers.

4) Messaging (SMS & Email)

  • Bluecrest enables communications such as “On the Way” and “Finished” notifications, broadcasts, and service emails. You represent that you have the necessary consent to contact your End Customers and that your content complies with applicable laws (e.g., TCPA, CAN‑SPAM).
  • You agree not to send unlawful, abusive, or misleading content. You are responsible for message charges and carrier fees.

5) Service Logs, Photos, and Reports

The Services allow technicians to record chemical readings, dosages, checklist items, notes, and photos. Company Users control how this information is shared with End Customers. You are responsible for the accuracy of entries and for retaining any records required by law or your business policies.

6) Privacy & Data

Our collection and use of personal information is described in our Privacy Policy. You represent that your collection and use of End Customer data via the Services complies with applicable privacy laws. Do not upload sensitive personal data unless required for your business and permitted by law.

7) Acceptable Use

  • No reverse engineering, scraping, or interfering with the Service’s operation.
  • No uploading malware or harmful code.
  • No infringing, deceptive, or illegal content.
  • Do not misrepresent your affiliation with Bluecrest or use our marks except as permitted in these Terms or with our written consent.

8) Intellectual Property

The Services, including software, designs, and content, are owned by or licensed to Bluecrest and are protected by intellectual property laws. Except for the limited rights expressly granted to you to use the Services, Bluecrest retains all rights, title, and interest.

9) Third‑Party Services

Certain features rely on third parties (e.g., Stripe, Google Maps, SMS providers). Your use of those features may be subject to third‑party terms and privacy policies. Bluecrest is not responsible for those services.

10) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, BLUECREST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, or error‑free.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUECREST WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO BLUECREST FOR THE SERVICES IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12) Term, Suspension, and Termination

  • These Terms apply while you use the Services. We may suspend or terminate access for non‑payment, policy violations, or risks to security or operations.
  • You may stop using the Services at any time. Some obligations (e.g., payment due, confidentiality, IP/use restrictions, and limitations of liability) survive termination.

13) Modifications

We may update these Terms by posting a revised version with a new “Last updated” date. Your continued use after changes constitutes acceptance.

14) Governing Law; Disputes

These Terms are governed by the laws of the state in which Bluecrest is primarily operated (without regard to conflict‑of‑law rules). The exclusive venue for disputes will be the state or federal courts located in that state, unless otherwise required by law.
